Internet giants take on spammers
12 March 2004
Four leading Internet firms have simultaneously filed lawsuits in the US against spammers.
America Online, Earthlink, Microsoft and Yahoo are all attempting to sue hundreds of spammers under anti-spam legislation for sending hundreds of millions of junk emails. The companies formed an alliance against spam in April last year.
Many of the spammers have not been named, but AOL claims to have received 100,000 member complaints about products promoted by spammer David Wolfgang Hawke.
The Internet companies claim they are confident that through subpoenas and other investigative tools they will be able to identify and find the spammers.
A total of six lawsuits have been filed against 220 spammers, alleging that the emails are deceptive, are sent through a third party computer to disguise their origin, have no unsubscribe option and use false email addresses or have no physical address for the advertisers.
The suits, filed in California, Georgia, Virginia, and Washington, accuse the spammers of sending unwanted email about prescription drugs, herbal potions, and weight loss plans.
The US CAN-SPAM act came into force on January 1 this year.
