Kazaa files against 'unnecessary' raids

10 February 2004

Online file-sharing site Kazaa has filed a motion calling for evidence against it to be ruled as 'inadmissible'.

Lawyers for Australian-owned Sharman Networks applied to have evidence collected during raids on 12 premises last week dismissed.

Sydney Federal Court allowed the raids in three Australian states to go ahead on Friday.

The raids were conducted by Music Industry Piracy Investigations (MIPI) which is funded by Universal, Festival Mushroom Records, EMI Music, Sony Music, Warner Music Australia and BMG Australia.

Music industry bosses want Kazaa, the world's largest file sharing network, closed down for alleged copyright infringement.

Kazaa has condemned the raids against universities, internet companies, and even the homes of Sharman's chief executive and technology director, as 'unnecessary'. The company claims it has already provided similar evidence for US legal proceedings.

The company filed a notice of motion in the Federal Court in Sydney to put the legal action on hold until Federal Court of Appeal proceedings in the US are finalised. A judge at the Australian Federal Court has now adjourned the case until February 20th.
