Second victory for pop-up firm

A firm responsible for unsolicited pop-up advertisements on the internet has won a second court victory.
US District Judge Nancy Edmunds ruled that pop-up ads from the advertising firm WhenU were unlikely to confuse surfers searching for home loans or other financial services.
The lawsuit was brought by online businesses that do not want other vendors' advertisements to be seen by their customers.
Wells Fargo and Quicken Loans sued the company, saying it should not be allowed to send ads to its web visitors because the ads obscure their sites and violate their trademarks.
The judge said that no harm had been proven, and that users should be able to tell the difference between sites they visited deliberately and the pop-ups.
